Allergens and Dietary Requirements Notice

A mandatory notice forming part of the Agreement. It records what the Host can and cannot represent about allergens, and the declaration the Guest gives when booking.

1. Status of this notice

1.1 This notice forms part of the Agreement between the Host and the Guest and is to be read together with the Terms and Conditions, and in particular clause 5 (Allergens, dietary requirements and assumption of risk), clause 11 (Limitation of liability) and clause 12 (Indemnity).

1.2 Acceptance of this notice is a condition of booking. The Guest confirms, by making a booking, that this notice has been read and understood before any payment was made.

1.3 Capitalised terms have the meanings given to them in the Terms and Conditions.

2. The Guest's declaration and warranty

2.1 The Guest warrants that, at the time of booking, the Guest has disclosed to the Host in writing, in full and with accuracy, every allergy, food intolerance, medical dietary restriction and dietary requirement affecting every member of the Party, whether or not the affected person is the Guest.

2.2 The Guest undertakes to notify the Host in writing, without delay and in any event no later than seventy-two (72) hours before the Experience, of any change to the information given under clause 2.1. The Host is under no obligation to accommodate any disclosure or change notified after that time, or after the Host has concluded procurement and preparation for the Experience.

2.3 A disclosure is effective only if made in writing to the Host through the booking form, the Guest's booking-management link or the Host's published email address. A disclosure made orally on the night, to a member of staff, or to any third party is not effective notice for the purposes of this notice.

2.4 The Guest acknowledges that the Host plans menus, procures ingredients and prepares food in reliance on the accuracy and completeness of the information given under clause 2.1, and that the Host would not accept the booking on the same terms without it.

3. The nature of the kitchen: no allergen-free representation

3.1 Experiences are prepared and served in single, shared working kitchens, frequently in private residences, private villas or third-party premises, in which surfaces, equipment, utensils, cookware, oils and storage are used in common across all dishes prepared for an Experience.

3.2 Allergens handled in those kitchens include, without limitation, cereals containing gluten, crustaceans, eggs, fish, peanuts, soya, milk and dairy, tree nuts, celery, mustard, sesame, sulphur dioxide and sulphites, lupin and molluscs.

3.3 THE HOST MAKES NO REPRESENTATION, WARRANTY OR GUARANTEE, EXPRESS OR IMPLIED, THAT ANY DISH, INGREDIENT, BEVERAGE OR PREPARATION IS FREE FROM ANY ALLERGEN OR FROM CROSS-CONTACT WITH ANY ALLERGEN. No food or drink supplied by the Host is offered, described or to be understood as "allergen-free", "free-from", "gluten-free", "nut-free" or otherwise safe for any person with a severe, anaphylactic or life-threatening allergy.

3.4 The Host does not operate a segregated allergen preparation area, does not hold itself out as a facility capable of eliminating cross-contact, and does not undertake to do so for any Experience.

4. Ingredient and supplier information

4.1 Ingredient, composition, provenance and allergen information is obtained by the Host from its producers, suppliers, importers and other third parties. The Host exercises reasonable care in obtaining that information but gives no warranty, and accepts no liability, as to its accuracy, completeness or currency.

4.2 Recipes, suppliers and produce change with the season and the market. Information given in respect of one Experience does not apply to any other.

4.3 The Host will, on request made in accordance with clause 2.3, state to the best of its knowledge and belief what a dish is understood to contain. Any such statement is given in good faith on the basis of information then available and does not constitute a warranty or a representation as to the absence of any allergen.

5. Severe allergies

5.1 Any person with a severe, anaphylactic or otherwise life-threatening allergy must disclose it expressly and in those terms at the time of booking, in accordance with clause 2.3.

5.2 The Host reserves the absolute right, on receipt of such a disclosure, to decline the booking or to cancel it, in which case the sums actually paid in respect of that person will be refunded and the Host shall have no further liability. The Host is under no obligation to accept a booking which, in its sole judgement, it cannot fulfil safely.

5.3 Where such a booking is nonetheless accepted, the Guest and the affected person acknowledge and accept that acceptance does not amount to a representation or warranty that the Experience is safe for that person, that clause 3.3 continues to apply in full, and that the affected person attends and consumes food and drink entirely at their own risk. Any person with such an allergy is strongly advised to carry their prescribed emergency medication.

6. Assumption of risk and acknowledgement

6.1 The Guest acknowledges, for itself and on behalf of every member of the Party, that attendance at an Experience and the consumption of food and drink at it are voluntary and carry inherent risks, including the risk of allergic, intolerant or otherwise adverse reaction, and that those risks are voluntarily assumed to the maximum extent permitted by applicable law.

6.2 The Guest acknowledges that the Host has made no representation that any Experience is suitable for any particular dietary, medical or religious requirement save where expressly confirmed in writing in respect of that Experience.

6.3 Subject to clause 11.1 of the Terms and Conditions, and to the maximum extent permitted by applicable law, the Host shall have no liability of any kind arising out of or in connection with (a) any allergy, intolerance or requirement not disclosed, or disclosed inaccurately, incompletely or late; (b) cross-contact with any allergen in the circumstances described in clause 3; (c) inaccurate or incomplete information supplied to the Host by a third party; or (d) the consumption by any person of any food or drink not supplied by the Host.

7. Private events at the Guest's venue

7.1 Where an Experience is prepared at premises nominated or provided by the Guest, the Guest is solely responsible for the condition, cleanliness, equipment, storage and food-safety compliance of those premises and their kitchen, and the Host shall have no liability whatsoever in respect of them or of any consequence arising from them.

8. What the Host does undertake

8.1 Nothing in this notice purports to exclude, and the Host does not seek to exclude, its obligation to exercise reasonable care and skill in the handling of information which has in fact been disclosed to it in accordance with clause 2, in the preparation and storage of food, and in complying with the food-safety requirements applicable to it.

8.2 Nothing in this notice operates to exclude or limit any liability which cannot lawfully be excluded or limited, and clause 11.1 of the Terms and Conditions applies to this notice in full.
